    Key Takeaways

    • Midterm odds: Bettors on Kalshi give Democrats a 90% chance of winning the House and 64% of winning the Senate, The Block reported.
    • Committee chairs: A Democratic Senate would make Elizabeth Warren chair of the Senate Banking Committee. Sherrod Brown could chair Senate Agriculture if he wins his Ohio race.
    • Clarity Act: The crypto market structure bill passed the House in July 2025 but fell 11 votes short of advancing in the Senate on September 15. TD Cowen expects a Democratic sweep to stall it for two years.
    • Money: The crypto industry has spent $176 million on more than 100 races, and the Fairshake super PAC committed $30 million to back Republican Jon Husted against Brown.

The crypto industry is bracing for tougher oversight as prediction markets favor Democrats to win both chambers of Congress in next week's midterms, The Block reported on October 28, 2026. Bettors on Kalshi put a 64% chance on Democrats winning the Senate and a 90% chance on the House.

What a Democratic Congress Would Mean for Crypto Oversight

If Democrats take the Senate, Warren, a Massachusetts Democrat, would chair the Banking Committee. Ron Hammond, head of policy and advocacy at the market maker Wintermute, told The Block he expects her to use subpoena power and be aggressive. "The question is not legislatively what she can do that's damaging because a lot of that would have to get signed by the president," Hammond said, adding that she could still stop measures that help the industry.

Warren said she was open to a deal on her terms. "I'd be happy to sit down with other Democrats, with the Republicans, and with the industry and hammer out a meaningful crypto bill that protects our national security, that protects our economy and that dials back the corruption," she said, adding that it would require Republicans to stand up to President Donald Trump.

The House Financial Services Committee would change hands too. Republican chair French Hill would lose the gavel, and Maxine Waters, who led the committee before, has been challenged for the top Democratic spot by Reps. Sean Casten and Bill Foster. Hammond said Casten would take a more aggressive stance on crypto.

The Clarity Act's Odds After the Midterms

A Republican Congress passed the GENIUS Act stablecoin law and worked on the broader Clarity Act. The House passed the Clarity Act in July 2025 by a 294-134 vote, and the Senate Banking Committee approved its version in May 2026 by 15-9, Bitcoin Magazine reported. On September 15 it got only 49 of the 60 Senate votes it needed to advance, with all Democrats and four Republicans voting no, NPR reported. The Block said the bill was derailed over Trump's crypto wealth, tied to World Liberty Financial and his TRUMP memecoin. Related WYDE coverage: the September 15 Clarity Act cloture vote.

Jaret Seiberg of TD Cowen wrote that a Democratic sweep would make it difficult for Congress to pass the Clarity Act over the next two years, Bitcoin Magazine reported. A wider Republican Senate majority would improve the bill's odds in 2027 or 2028, he wrote. Andrew Cuomo, the former New York governor who now sits on the board of crypto exchange OKX, told reporters he does not expect action in the lame-duck session. "Forget politics, if you believe the prediction markets, one or both houses may become led by Democrats," Cuomo said.

Crypto Money in the Ohio Senate Race

One of the races the industry is watching is Ohio. Brown, a former Senate Banking chair who criticized a 2022 crypto market structure bill, faces Husted, whom The Block called crypto-friendly. After the Clarity Act vote, the Fairshake political action committee committed $30 million to back Husted. By WYDE's arithmetic, that is about 17% of the $176 million the crypto industry has spent on more than 100 races, as Bitcoin Magazine tallied it. If Brown wins, his seniority could make him chair of the Senate Agriculture Committee, Hammond said, a post from which he could put crypto bills from the House Agriculture Committee on ice, The Block reported. The Blockchain Association's chief policy officer, Lindsay Fraser, said in a statement that control of Congress may change but the need for clear crypto rules will not.
